LEGAL
Privacy Policy
Effective and last updated: September 10, 20261. Scope
This Privacy Policy explains how Instinction (“Instinction,” “we,” “us,” or “our”) handles personal information when you visit instinction.com, create an account, analyze a channel, use creator tools, contact support, join a paid plan, or participate in a referral program.
2. Information we collect
Information you provide
- Account details such as name, email address, password in hashed form, and account preferences.
- YouTube channel URLs, niche, goals, competitor channels, draft titles, draft descriptions, and other information submitted to the tools.
- Support messages and the contact details provided with them.
- Referral codes and activity connected with Instinction’s referral programs.
Information collected automatically
- Pages visited, referral source, campaign parameters, device category, session identifier, and event timestamps.
- Product activity such as scans, saved reports, connected channels, usage levels, feature interactions, and email-delivery events.
- Cookies or similar storage used for sessions, referral attribution, preferences, security, and analytics.
Public YouTube information
When a channel is submitted, we may retrieve public information such as channel identifiers, names, handles, profile images, descriptions, subscriber or view totals where available, public videos, thumbnails, titles, descriptions, duration, publication dates, views, likes, and comments. Public YouTube data may describe a channel owner even when the person using Instinction is not that owner.
Payments
Stripe processes checkout, payment methods, subscriptions, invoices, discounts, and billing-portal activity. We receive identifiers and status information needed to activate and manage access. We do not store complete payment-card numbers.
3. How we use information
- Provide, personalize, save, and improve channel analysis, competitor tracking, growth plans, title tools, and reports.
- Create and secure accounts, authenticate sessions, reset passwords, and enforce plan limits.
- Process subscriptions, apply referral or promotion benefits, and maintain membership access.
- Send transactional messages and, when permitted, product or competitor updates.
- Measure traffic and the account-to-subscription funnel, prevent misuse, troubleshoot errors, and protect the service.
- Respond to support requests, comply with law, and enforce our Terms.
4. How we disclose information
We disclose information only as reasonably necessary to operate Instinction, including to service providers that host the site and database, send email, process payments, provide analytics, or supply public YouTube data. These currently include Stripe, Resend, Google Analytics, YouTube/Google APIs, and our hosting and infrastructure providers. We may also disclose information to comply with legal obligations, protect rights and safety, investigate abuse, or complete a merger, financing, acquisition, or sale of assets.
Instinction does not sell personal information for money and does not currently use personal information for cross-context behavioral advertising. If that changes, we will update this policy and provide any legally required choices.
5. Cookies and analytics
Essential cookies keep users signed in, secure admin access, and attribute referral activity. Local or session storage may preserve referral information, saved-page state, and cached deterministic recommendations. Google Analytics may collect usage information; IP anonymization is enabled in our current implementation. Browser controls can limit cookies, but blocking essential storage may prevent sign-in or saved features from working.
6. Retention
We retain account, subscription, saved channel, report, competitor, referral, support, security, and usage information for as long as reasonably needed to provide the service, maintain business and tax records, resolve disputes, prevent abuse, and comply with law. Password-reset tokens and sessions expire. Public YouTube information may remain in a saved or cached report until it is refreshed or deleted. We may retain deidentified or aggregated information where lawful.
7. Your choices and privacy rights
You may update certain account or billing information through Instinction or Stripe, disable available competitor-email preferences, and cancel a subscription through the billing portal. You may request access, correction, deletion, or a copy of personal information by contacting us. Depending on your state, you may also have rights to opt out of certain sales, targeted advertising, or profiling; appeal a denied request; limit certain sensitive-data uses; or receive information about disclosures. We will verify requests and honor applicable rights. Authorized agents may submit requests where state law permits.
Because Instinction does not currently sell personal information or use it for targeted advertising, there is no sale or targeted-advertising opt-out to process at this time. We will not discriminate against you for exercising an applicable privacy right.
8. Security
We use reasonable administrative and technical safeguards, including hashed passwords, expiring sessions and reset tokens, server-side credentials, and Stripe-hosted payment collection. No online service can guarantee absolute security. Do not submit passwords, payment-card numbers, API keys, or other secrets through support forms or creator text tools.
9. Children
Instinction is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information, contact us so we can investigate and delete it where required. Users must also meet the minimum-age requirements in our Terms.
10. Third-party services and public content
Links to YouTube, Stripe, social networks, browser extensions, or other services are governed by those providers’ policies. Instinction’s analysis of public content does not create an affiliation with, endorsement by, or ownership interest in a featured or analyzed channel.
11. Changes
We may update this policy as the service or law changes. We will post the revised policy with a new effective date and provide additional notice when legally required.
12. Contact
For privacy questions or requests, use the contact form or email support@instinction.com. Instinction is based in Florida, United States.
